Shall Terms of Service Trump Public Licenses? - clacke

First, you own the copyright to any original work that you have created. But
that means the right to copy your work, not the right to get a copy. Nobody can
be forced to give you copies of any of your works, unless you have some service
agreement with them.

Not even the GPL requires that anybody distribute anything, it merely says
that *if* one distributes X, or more exactly, *in order to be allowed* to
distribute X, one needs to also do Y.

Second, yes, you may say that a separate agreement with some party trumps
whatever license you have stated for the general public. You can publish a work
to the general public under CC-by-SA and at the same time sell it to some
specific party under entirely separate conditions.

An artist might for example publish songs under CC-by-SA on their web site
and at the same time sell them to some publisher under an agreement that
demands royalties and in exchange doesn't require the publisher to give its
customers any rights regarding the data distributed. See http://www.gnu.org/philosophy/selli...
for a software-oriented example.

The TOS you agreed to when using Flickr's service may or may not give them
additional rights beyond those of whatever CC license you used for your works.
Regardless, they are not required to provide you the service of giving you your
data unless that's something you and they explicitly agreed to.

It seems they didn't agree to do it for free.
